Notice of Proposed Rulemaking

Proposed Amendment to the 'Regulations for the Designation and Operation of Home Health Agencies'

The Department of Disabilities, Aging and Independent Living (DAIL) is proposing to amend the Regulations for the Designation and Operation of Home Health Agencies by striking the current regulations in their entirety and, due to the extent of the proposed changes, replacing them with new ones.  The proposed amendment seeks to address both technical and substantive issues.  Examples include re-organizing existing content; editing for enhanced clarity; adding and deleting definitions; modifying definitions to replicate federal definitions where appropriate; to avoid redundancy, deleting provisions that are required by the Federal Conditions of Participation, with which all home health agencies must comply; and modifying and clarifying appeals provisions.
