Revision to Regulation Implementing the DD Act Resubmitted to LCAR

The Department of Disabilities, Aging and Independent Living (DAIL) is proposing to amend the Regulations Implementing the Developmental Disabilities Act of 1996 in furtherance of the requirements set forth in 18 V.S.A. § 8725.  Specifically, DAIL is seeking to adopt by administrative rule the following categories of the State System of Care Plan for Developmental Services:

(1) priorities for continuation of existing programs;

(2) criteria for receiving services for funding;

(3) type of services provided; and

(4) a process for evaluating and assessing the success of programs.

After attending the April 6, 2017 meeting of LCAR (Legislative Committee on dministrative Rule) DAIL noticed and scheduled an additional public hearing, which was held on May 25, 2017, and extended the public comment period through May 30, 2017.  After reviewing the additional comments received, DAIL pepared responses to those comments and further modified the Final Proposed Rule, which has been re-submitted to LCAR.  Please find the following:
